If you can not afford the civil filing fee, please complete 1) Motion and Declaration for Reduction or Waiver of Fees, 2) Financial Statement, and 3) Order for Reduction or Waiver of Filing Fees and turn in to the court with your Complaint or Petition.

Domestic Violence Protection Order Forms

In the section below are forms that you may use in order to Petition the Kalispel Tribal Court for an Order of Protection against domestic violence. No filing fee is required to petition the Kalispel Tribal Court for an Order of Protection. Below are definitions that may be of assistance.

You may be eligible for assistance in completing these forms from either  Kalispel Tribe Victim Assistance Services (509-447-7155) or Gonzaga Law School Clinical Legal Programs (see application forms above).

“Domestic violence” means: (a) Physical harm, bodily injury, assault, or the infliction of fear of imminent physical harm, bodily injury or assault, between family or household members; (b) sexual assault of one family or household member by another; or (c) stalking of a family or household member by another family or household member. 

“Family or household members” means spouses, domestic partners, former spouses, former domestic partners, persons who have a child in common regardless of whether they have been married or have lived together at any time, adult persons related by blood or marriage, adult persons who are presently residing together or who have resided together in the past, persons sixteen years of age or older who are presently residing together or who have resided together in the past and who have or have had a dating relationship, persons sixteen years of age or older with whom a person sixteen years of age or older has or has had a dating relationship, and persons who have a biological or legal parent-child relationship, including stepparents and stepchildren and grandparents and grandchildren.

“Judicial day” does not include Fridays, Saturdays, Sundays, Tribal Government closures/holidays or Legal holidays.
